JUDGEMENT

(1.) Heard Mr.S.I.Muthiah for the civil revision petitioner, Mr.D.Siva Raman for the first respondent and Mrs.D.Farjana Ghoushia, Special Government Pleader, for respondents 2 and 3.

(2.) This Civil Revision Petition challenges the order passed by the learned Subordinate Judge at Thuraiyur, in allowing the appeal filed by the son of the third defendant, challenging the dismissal of an application filed under Order IX Rule 13 of the Code of Civil Procedure.

(3.) For the sake of convenience, the parties shall be referred to as their ranks in the suit.
