Y JAYAPRAKASH Vs. COMMISSIONER OF POLICE

JUDGEMENT

(1.) THE petitioner, Y. Jayapraksh has filed this petition seeking direction to the respondents to produce the body of the detenue Sivaranjani before this Court and set her at liberty.

(2.) PURSUANT to the direction of this Court, the detenue by name Sivaranjani appeared before us. We enquired her. According to her, she is 23 years old; as on date she is a major and her date of birth being 24. 11. 1983. She further informed us that though the petitioner is her husband, due to various reasons / strained relationship, she is not willing to live with him.

(3.) IN the light of her statement and assertion as well as of the fact that she being a major and not under the illegal detention of any one, we are of the view that no further adjudication is required in this petition; accordingly, the same is closed. The parties are free to vindicate their grievance before the appropriate forum.
