Decided On March 03, 2006
MUTHULAKSHMI Appellant
V/S
HEMALATHA Respondents

JUDGEMENT

(1.) THE petitioner by name Mahalakshmi has filed this Petition seeking for direction to the respondents to produce her husband, viz. , Eswari Prasad, aged about 30 years, before this Court and set him at liberty.

(2.) PURSUANT to the direction of this Court, detenu Eswari Prasad appeared before us. We enquired him. It is brought to our notice that pursuant to the complaint of the petitioner, the detenu and four others filed crl. O. P. No. 2791 of 2006 before this Court. A learned single Judge of this court, by order dated 15. 02. 2006, while granting anticipatory bail subject to certain conditions, directed the parties to appear before the Mediation and conciliation Centre in this Court to sort out their dispute. In the enquiry before us, detenu Eswari Prasad has also expressed that, pursuant to the direction of the learned single Judge in the order dated 15. 02. 2006, he is willing to appear before the Mediation Centre. The petitioner, who also appeared before us, is anxious to settle the dispute and desires to live with her husband, detenu Eswari Prasad.

(3.) IN view of the order of the learned single Judge and of the fact that the detenu is not in illegal custody or detention of any one including respondent Nos. 3 and 4, we are of the view that no further adjudication is required, particularly in the light of direction to the parties for sorting out their dispute before the Mediation and Conciliation Centre. Accordingly, the Habeas Corpus Petition is closed.
