MURTHI Vs. SUPERINTENDENT OF POLICE

JUDGEMENT

(1.) This Writ of Habeas Corpus Petition has been filed seeking a direction to respondents-Police 1 and 2 herein to produce the petitioner's minor daughter Desika, aged about 9 years and wife Nithya, aged about 28 years, before this Court.

(2.) According to the petitioner, his wife Nithya, aged about 28 years, had eloped with the third respondent herein. After the petitioner made continuous efforts to locate her, she returned home on her own and agreed to reside with him. However, on 12/4/2024, she once again eloped with the third respondent along with her minor daughter Desika. Hence, a case in Crime No.153 of 2024 was registered for ''Women Missing and Girl Missing''. Since no action was forthcoming the respondents-Police, the petitioner has approached this Court by filing the present petition.

(3.) The learned Additional Public Prosecutor appearing for the respondents 1 and 2, on instructions, submitted that after registering the case, the respondents-Police secured the minor child Desika, who is presently with the petitioner.
