(1.) V . Ramasubramanian, J: 1. A tender was floated in May, 2012, by the Tamil Nadu Civil Supplies Corporation Limited for the Transportation of Essential Commodities from the Food Corporation of India Depots to the Tamil Nadu Civil Supplies Corporation Storage Points, for the period from 01.07.2013 to 30.06.2014. Insofar as Tirunelveli Region was concerned, the date of the tender was 04.06.2013 and 05.06.2013. On 04.06.2013, Part -I Technical Bids were opened and on 05.06.2013, Part -II Price Bids were opened.
(2.) ONLY three persons participated in the tender on 04.06.2013 for Tirunelveli Region. The appellant herein and the 1st respondent herein were among those three persons. It was seen, after the opening of Price Bids on 05.06.2013, that the appellant as well as the 1st respondent herein had quoted the least and the same rates. Consequently, both of them became what is known as L1.
(3.) SIMILARLY , in respect of another region, namely Virudhunagar, the appellant became the least tenderer. The tender conditions stipulated that a person is entitled to participate in any number of regions, subject to the condition that they own a minimum of five lorries and show atleast a tie -up for 10 lorries for each region, in respect of each category. There was also one more condition that such a person should produce 15 lorries, bearing different registration numbers for each region and each category, failing which the bid for the additional region will be rejected.
