JUDGEMENT

(1.) THE petitioner has filed this petition under Section 482 Cr.P.C., praying to direct the second respondent to register the complaint given by the petitioner dated 22.08.2013.

(2.) THE learned Government Advocate (Crl. side) would submit in his arguments that the complaint will be taken and it will be enquired into and if any prima facie case is made out, the said complaint would be registered and the investigation would also be commenced.

(3.) THE concerned police is directed to take note of the Constitution Bench decision reported in : 2013 4 MLJ (Crl) 579 SC mentioned supra and not to act according to their whims and fancies. Further, this Court is very clear that in the case of closure report, a copy of the closure report should be given to the petitioner within a week. The Magistrate to whom a copy of the report is forwarded under Section 173 is expected to comply with the various provisions of the Code of Criminal Procedure, 1973; the police is also expected to comply with Section 173(8) of the Code of Criminal Procedure, 1973, wherever it is necessary, if there are no legal impediments.
