ANJALAKSHI Vs. STATE OF TAMIL NADU AND OTHERS

Decided On March 26, 1993
Anjalakshi Appellant
V/S
STATE OF TAMIL NADU AND OTHERS Respondents

JUDGEMENT

(1.) A letter for Anjalakshi addressed to the Law Minister, State Government, with a copy to the Honourable the Chief Justice, on the directions on the Honourable Chief Justice, was placed before us for suitable orders in the interest of justice.

(2.) Anjalakshi claims in her petition that Ayyanar who has been preventively detained and now incarcerated in Central Prison, Cuddalore, was helping her father in running a petty ship. Though Ayyanar has no bad antecedents, somehow or other, to prevent her marriage with him, local police had taken preventive action. She has also enclosed a wedding invitation, which discloses that her marriage with the detinue Ayyanar has been fixed to be celebrated on 29.3.1993 between 4.30 and 6.00 a m. at "Sri Vasavi Thirumana Mandapam" Door No. 328, Kamarajar Street, Villupuram. Invitation has been issued by A. Govinda Gounder, Ex-President of Thenkuchipalayam and B. Kothan-dapani, Founder of Akkadavalli, who is the senior paternal uncle of detinue.

(3.) Since the letter is addressed to the Law Minister of the State Government, we requested Mr. B. Sriramulu, learned Public Prosecutor, to ascertain from the State Government if orders had already been passed concerning the request for parole of Anjalakshi. In-spite of his efforts, learned Public Prosecutor was not able to obtain any useful information about the application of Anjalakshi having been processed by the State Government. Learned Public Prosecutor had only thirty minutes at his disposal to gather information. Since 27th and March, 1993 are holidays, learned Public Prosecutor is disabled from persuading the Government to dispose of this application as they deem fit under the circumstances.
