SILUKKUVARPATTI PANCHAYATH Vs. GOVERNMENT OF TAMILNADU

JUDGEMENT

(1.) THE petitioner seeks for a direction to the respondents to take effective steps to provide modern water supply scheme to the residents of the petitioner panchayath based on the representation dated 08.11.2009.

(2.) THE petitioner is the Silukkuvarpatti Panchayath, represented by its President. According to the petitioner, there are 15,000 families and more than 50,000 people are residing in the said panchayath. The existing water scheme was commenced 27 years ago while the population was very thin. Over the period of 3 decades, the entire machineries, pipes, submarine well in the river side and pumping motor were worn-out and ruined. The respondents never took any steps or care to solve the water problem due to the water leakage from the broken pipe. Therefore, the petitioner made a representation to the first respondent on 08.11.2009 seeking for replacement of ruined pipeline connection and other machineries. They also requested for providing 2 lakhs litres capacity of water tank with pipe line connection to the petitioner panchayath and also for a new well. As the said representation was not considered, the present Writ Petition has been filed.

(3.) ,95,160/- litres per day as per the Government norms. Accordingly, the fourth respondent has stated that the petitioner's need has been taken care of, and if the panchayat need more schemes for more water, then they have to make such schemes from their own panchayath fund. 4. From the counter affidavit filed by the fourth respondent, it is seen that during the year 2007, the scheme was formulated for providing water supply including the petitioner's panchayath. As it is stated that 6,74,000 litres per day is being supplied to the petitioner panchayath and in spite of such averments made by the fourth respondent, if the petitioner panchayath feels that it is not sufficient and it requires more quantity of water or further more schemes to be formulated for providing water supply to the petitioner panchayath, it is for them to approach the authorities and make an appropriate representation.
