Decided On January 09, 2013
J. Sumathi Appellant
V/S
SUPERINTENDENT OF POLICE Respondents

JUDGEMENT

(1.) THIS Habeas Corpus Petition has been filed praying that this Court may be pleased to direct the respondents to produce the detenu, namely, Jhonson, aged about 45 years, the husband of the petitioner, before this Court and to set him at liberty.

(2.) THE petitioner has stated that she was married to the detenu and they had been living together, happily, for about 20 years. Out of the wedlock, three children, namely, Jesudoss, Jeya and Stephenraj had been born. While so, the detenu had gone to Coimbatore, in search of a job, on 01.07.2012. Thereafter, he had not returned back to his house. It has been further stated that, on enquiry, she had found that the third respondent had developed illicit intimacy with the husband of the petitioner and that she had abducted him and keeping him under her illegal custody. In such circumstances, the petitioner had preferred a complaint before the second respondent, on 10.07.2012. Since, no effective steps had been taken, by the second respondent, to trace the detenu, the petitioner has preferred the present Habeas Corpus Petition before this Court.

(3.) IN view of the statement made by the Additional Public Prosecutor appearing on behalf of the respondents 1 and 2, this Court is of the view that no further orders are necessary in the present Habeas Corpus Petition. Hence, the Habeas Corpus Petition stands closed.
