M.MURUGAN Vs. STATE

JUDGEMENT

(1.) The petitioner, who was arrested and remanded to judicial custody on 5/10/2022 for the offences punishable under Ss. 7(5), 20(2) of Cigarette and other Tobacco Products Acts, 2003, r/w Sec. 328 of IPC in Crime No.83 of 2022 on the file of the respondent police, seeks bail.

(2.) The case of the prosecution is that when the respondent police and his team were on their routine check up, the petitioner was found in illegal possession of 42.420 kilograms of banned tobacco products, worth about Rs.31,440.00. Hence the complaint.

(3.) The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would also submit that without prejudice, the petitioner is prepared to make a deposit an amount of Rs.30,000.00 as non-refundable deposit to any welfare scheme of the Government and hence, he prays for grant of bail to the petitioner.
