JUDGEMENT

(1.) The prayer sought for herein is for a Writ of Certiorari, to quash the proceedings of the first respondent in No.R3/Dr.KAS/Asst. Prof./Change of Pay Band/2019 dtd. 2/8/2019 reverting the petitioner from the post of Associate Professor to Assistant Professor (stage 3) with effect from 11/1/2019 and to refix the pay immediately with effect from 6/4/2015 and to further recover the excess amount paid to the petitioner from 6/4/2015.

(2.) The petitioner was initially appointed as an Assistant Professor, Horticulture in Pandit Jawaharlal Nehru College of Agriculture and Research Institute, Karaikal [in short,'PAJANCOA). By proceedings dtd. 24/3/2008, he was placed in the senior scale in the scale of pay of Rs.10,000.00325-15,200 with effect from 24/1/2007. By order dtd. 6/7/2009, the petitioner was declared to have completed satisfactory probation with effect from 24/1/2005.

(3.) Thereafter since there was a situation for Assistant Professor vacant in the respondent University i.e., Tamil Nadu Agriculture University [in short, 'TNAU'], the petitioner's made application. Considering the application submitted by the petitioner, who having been selected, was appointed as an Associate Professor, Horticulture at the respondent University in the year 2010.
