JUDGEMENT

(1.) The relief sought for in the present writ petition is to direct the respondents to extend the benefit of the G.O.Ms.No.210, School Education Department dtd. 14/8/2009 in so far as the petitioner is concerned and accordingly award special grade scale of pay in the post of B.T. Grade Middle School Head Master by counting his lower grade secondary Grade Assistant Service, Elementary School Head Master Service as has been granted to 60 similarly placed persons.

(2.) The petitioner states that he is a retired Assistant Elementary Educational Officer and has filed the present writ petition after a lapse of about six years from the date of his retirement. The Government Order was issued in G.O.Ms.No.210 School Education Department dtd. 14/8/2009. Regarding the eligibility of the writ petitioner, the respondents have stated in their counter affidavit that the petitioner is not falling under the ambit of G.O.Ms.No.210 School Education Department dtd. 14/8/2009. In this regard, it is relevant to extract Paragraph No.13 of the counter, which reads as under:
