JUDGEMENT

(1.) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Ss. 408, 420, 465, 468, 471 and 477A of IPC, in Crime No. 503 of 2020, on the file of the respondent police, seek anticipatory bail.

The case of the prosecution as per the defacto complainant viz., D.Harikrishnan, Manager of the "Vishal Film Factory" is that the first petitioner was working as an accountant, one Sivaganesan was working as an Assistant and one Sarvanan was working as a Cashier and that the first petitioner was incharge of all the accounts and income tax transactions. While so, the first accused had by fabrication of documents, falsification of accounts and illegal diversion of funds committed criminal breach of trust and misappropriated amount to the tune of Rs.45,00,000.00. Hence, the complaint.

(3.) The learned counsel for the petitioners would submit that this is the fourth application for Anticipatory Bail. He would further submit that the first application for Anticipatory Bail was dismissed on the ground that investigation was in the initial stage and that if the petitioners are granted Anticipatory Bail, there is every chance of them to interfere with the investigation. The First application for Anticipatory Bail in Crl.O.P.No.10985 of 2020 was dismissed on 12/8/2020 and thereafter, the second application was dismissed on 9/9/2020 stating that there was no change of circumstances and the third application was dismissed as withdrawn. He would further submit that during the course of preliminary investigation, the first petitioner has repaid an amount of Rs.10,00,000.00 and car worth about Rs.7,00,000.00 was taken by the defacto complainant. The petitioner had also handed over the T.O. Forms for transfer of the vehicle. However, subsequently, car and the documents were returned to the petitioner. They were also referred to the mediation, however, it had failed.
