(1.) THOUGH the challenge in this Writ Petition is against a show-cause notice issued by the first respondent, dated 07.07.2006, I propose to consider the Writ Petition on merits in view of the following facts and circumstances.
(2.) THE case of the petitioner is that she passed B.Sc degree in Home Science in the year 1997 and also passed B.Ed degree during the year 2002. She got enrolled her name with the Employment Exchange of Virudhunagar District. During the year 2004, the second respondent invited applications for appointment to the post of B.T.Assistant under Scheduled Castes category. The petitioner applied to the said post and also attended the interview. Thereafter, on 15.04.2004 she was selected and appointed as B.T.Assistant in the second respondent/school on a monthly salary of Rs.4000.00. Such appointment of the petitioner was also approved by the first respondent through his proceedings, dated 28.05.2004. The petitioner is taking classes for the subjects like science, English, Tamil. While that being the position, all of a sudden, the impugned show-cause notice was issued by the first respondent calling upon the petitioner to give explanation as to why she should not be removed from the post on the reason that her bachelor's degree in Home Science subject is not qualified for appointment to the post of B.T.Assistant. Pending further orders, salary to the petitioner from the month of July 2006 was also ordered to be stopped. Hence the present Writ Petition is filed before this Court.
