P. MAHESWARI Vs. DIRECTOR OF ELEMENTARY EDUCATION

JUDGEMENT

(1.) THE petitioner prays for the issuance of a Writ in the nature of Mandamus, directing the third respondent to consider the petitioner for promotion to the post of Graduate Assistant (B.T. Assistant) in Maths at M.Duraichamypuram Panchayat Union Primary/Middle School or in any other vacant posts within Vembakkottai Union, within the time period to be stipulated by this Court.

(2.) THE Writ Petition as framed is not competent. This Court cannot regulate the administrative functions of the State Government. It is for the Government to take a decision with regard to the filling up of the post. The petitioner gets the right of consideration, when the process of promotion commences, if eligible.

(3.) IT is contended that one post of graduate assistant (B.T. Assistant in mathematics) is vacant, therefore, considering the seniority of the petitioner, she has to be promoted against vacant post.
