JUDGEMENT

(1.) THE petitioner has invoked the extraordinary equitable jurisdiction of this Court praying for issuance of a Writ in the nature of Mandamus, directing the respondents to promote the petitioner to the post of B.T.Assistant(Maths) against the vacancy at Panchayat Union Middle School, Kadamalai, Myladumparai Union, THEni District as per the panel for promotion as on 01.01.2012 issued by the third respondent.

(2.) IN support of the prayer in the Writ Petition, it is pleaded that the petitioner is holding a degree in B.Sc(Maths). with B.Ed and was appointed as a Secondary Grade Teacher in Panchayat Union Primary School on 22.01.2001. The petitioner is now working as Secondary Grade Teacher at panchayat Union Middle School, Velayuthapuram, Kadamalai, Myladumparai Union, Theni District. The service of the Petitioner was regularized on 22.01.2001 and he cleared the probation on 21.01.2003. The petitioner as on date has put in 12 years of service. It is submitted that the middle Schools were upgraded under SSA Scheme and promotions for B.T.Assistant in the subjects of English, Science and Mathematics is given to the qualified and eligible Teachers in the subject working in the same schools.

(3.) THE Petitioner had joined the present place on 06.08.2007 and the name of the petitioner included in the promotion panel for B.T.Assistant(Maths) for the current year as on 01.01.2012 at S.No.2.
