(1.) THE petitioner is a differently abled person. He passed Higher Secondary examination with 40% marks during the year 2003.

THE petitioner filed W.P.(MD) No.3159 of 2005, seeking for direction to the Education Department of the Tamil Nadu Government, to grant relaxation of the rules requiring 45% marks in the higher secondary examination for being admitted in Teacher Training Courses, since he is differently abled person. This Court disposed of the writ petition, by passing order dated 03.02.2005, directing the government, to consider the representation of the petitioner, dated 05.01.2005 and to pass appropriate orders within four weeks from the date of receipt of a copy of that order, relating to grant of relaxation in marks as the petitioner is a differently abled person.
(3.) IN the said circumstances, the third respondent herein, admitted the petitioner in their Institution for Teacher Training Course. Thereafter, the third respondent sought for approval for admission from the first respondent. The first respondent passed an order dated 21.10.2009, refusing to approve the appointment of the petitioner. The reason for refusing the approval for appointment is that he failed to secure 45% of marks in higher secondary examination and also that he does not suffer 70% disability and he suffers only 45% disability as per the certificate.
