JUDGEMENT

(1.) THIS is an appeal by the accused Thangavelu against the judgment dated 13th August, 1979 in S.C. No.49 of 1979 on the file of the Court of the Learned Sessions Judge, North Arcot at Vellore finding him guilty under section 302, Indian Penal Code, convicting him thereunder and sentencing him to undergo imprisonment for life.

(2.) THE case against the accused before the trial Court is that on or about the 12th day of December, 1978 at about 5.00 p.m. in Iyer -s rice mill at Arcot, the accused, caused the death of his wife Anna booshanam by stabbing her with a pen knife on her chest, abdonmen and other places of her body and thus caused her fatal injuries and thereby committed an offence punishable under section 302, Indian Penal Code.

(3.) THE prosecution had let in oral evidence through P.Ws.1 to 18, documentary evidence Exhibits P.1 to p.32 and also produced M.Os. 1 to 9 to substantiate the case put forward by it against the accused in the trial Court.
