JUDGEMENT

(1.) Challenge in this second appeal is made to the Judgement and Decree dated 29.09.2006 passed in A.S.No.112 of 2005 on the file of the Principal District Court, Coimbatore, confirming the judgment and decree dated 20.11.2004 passed in O.S.No.108 of 2001 on the file of the II Additional Subordinate Court, Coimbatore.

(2.) For the sake of convenience, the parties are referred to as per their rankings in the trial Court.

(3.) The defendant in O.S.No.108 of 2001 is the appellant in this second appeal.
