JUDGEMENT

(1.) The Petitioner prays for issuance of a writ, in the nature of certiorari, to quash the order, dated 6.9.2006, vide which the request of the Petitioner, for change of seniority list stands declined.

(2.) No basis has been made out to challenge the seniority list nor seniority list has been placed on record by the Petitioner. The only prayer made in the writ petition is, that the Petitioner should be directed to be promoted with retrospective effect from 25th Feb 1996.

(3.) No such direction can be issued to promote an employee with retrospective effect. The only exception being when person junior to an employee stands promoted, without considering the case of the senior in that event, senior can claim promotion from the date of his junior.
