JUDGEMENT

(1.) THE award passed in W.C. No. 540 of 2004 by the Commissioner for Workmen 's Compensation (Deputy Commissioner of Labour), Tiruchirapalli is being challenged in the present Civil Miscellaneous Appeal.

(2.) THE Respondents herein as Petitioners have filed W.C. No. 540 of 2004 on the file of the Commissioner for Workmen 's Compensation (Deputy Commissioner of Labour), Tiruchirapalli praying to pass an award of Rs.5,00,000/ - wherein the present Appellant has been shown as sole Respondent.

(3.) IN the Counter filed on the side of the Respondent it is stated that the deceased Manoharan has had no connection whatsoever with the employment of the Respondent and he has not served in the Hotel which belongs to the Respondent. The deceased has passed away due to heart attack in his residence on 16.1.2004 and there is no merit in the Petition and same deserves to be dismissed.
