JUDGEMENT

(1.) The Petitioner, who voluntarily surrendered and remanded to judicial custody on 06.01.2020 for the alleged offences punishable under Sections 341 and 302 IPC @ 341, 302, 147, 148 and 120 (B) of IPC in Crime No.10 of 2020, on the file of the respondent police, seeks bail.

(2.) The case of the prosecution is that on 05.01.2020, the defacto complainant Nirmala had lodged a complaint before the respondent police stating that on 04.01.2020 at about 11.00 p.m., she received a phone call that her son namely Veera @ Veerapandi who has already involved in many serious crimes and also confined in Jail for several times, had done to death at the entrance of the Sangeetha Hotel, Kilambakkam Signal by some unidentified persons because of previous enmity. Hence the complaint has been registered.

The learned counsel for the petitioner would submit that the family members of the petitioner were arrested and kept under illegal custody by the respondent Police and therefore, the petitioner voluntarily surrendered before the respondent police to safeguard his family members from the illegal arrest and that the petitioner is an innocent person and he is nothing to do with the alleged offence. The co-accused in this case viz., A2, A4 and A5 were already granted bail by the Principal District and Sessions Court, Chengalpattu and A3 was granted bail by this Court in Crl.O.P.No.4783 of 2020, dated 04.03.2020. He further submitted that the petitioner had sustained serious injuries in his leg when he met with an accident and the injury has resulted in infection. Thereafter the petitioner had taken treatment in the Government Stanley Hospital. Now due to covid-19 lockdown, he is unable to follow up the treatment. He would further submit that the petitioner needs urgent surgery on his leg otherwise, the petitioner's health condition would become deteriorate. Hence he seeks for grant of bail to the petitioner.
