(1.) The Civil Miscellaneous Petition is filed to condone the delay of 415 days in filing the appeal suit, challenging the judgment and decree dated 08.06.2017 passed in O.S.No.592 of 2013.

The learned counsel appearing on behalf of the petitioner made a submission that the petitioner was in distress on account of pressure by the respondents and this apart, she was psychologically and monetarily suffering on account of the attitude of the 1 st respondent, who is none other than the father-in-law of the 1 st petitioner.

The learned counsel for the petitioner urged this Court by stating that the 1st petitioner was not in a position to file the appeal suit as she was not having sufficient income to meet out the appeal expenditures. It is stated that the 1st petitioner was financially weak and illiterate and therefore, the delay is to be condoned. Such reasons are stated in paragraph 19 of the affidavit filed in support of the miscellaneous petition.
