JUDGEMENT

(1.) Both the second appeals are arising out of appeal suit in AS.No.155 of 2004 and Cross Appeal No.203 of 2004. Therefore it is appropriate to pass common judgment in both the appeals.

(2.) For the sake of convenience, the parties are referred to as per their rankings in the trial Court.
