JUDGEMENT

(1.) THE learned counsel appearing for the appellant had submitted that the matter had been settled out of Court. THErefore, he seeks permission of this Court to withdraw the second appeal. He has also made an endorsement to that effect. In view of the endorsement made by the learned counsel appearing for the appellant, the second appeal stands dismissed as withdrawn. No costs. Consequently, connected M.P.No.1 of 2010 is closed.
