JUDGEMENT

(1.) The Writ Appeal is directed against the order of the learned Single Judge dated 15.9.2010 passed in W.P.(MD) No. 11760 of 2010 by which the learned Judge has dismissed the Writ Petition filed by the Petitioner against the impugned order of the third Respondent dated 31.8.2010 by which the third Respondent has relieved the Petitioner from his present post at Rajapalayam.

(2.) The Appellant's grievance is that in the relieving order, there is no posting given to him. However, Reference 1 of the impugned order makes it clear that the second Respondent/the Commissioner had already passed an order dated 31.8.2010 posting him to the transferred place. The Petitioner had not taken steps to obtain the posting order but had chosen to file the Writ Petition, which came to be dismissed by the learned Judge, which in our considered view, does not require any interference.

(3.) Accordingly, the Writ Appeal stands dismissed, making it clear that after obtaining the posting order, it is open to the Appellant to challenge the same in the manner known to law. No costs. Connected Miscellaneous Petition is closed.
