JUDGEMENT

(1.) The petitioner, who is a practising advocate and stands arrayed as 1st accused in Crime No.73 of 2007 on the file of the respondent police for offence under Sections 147, 153(A), 341, 188 and 506(ii) IPC r/w. Section 71A of CLA Act seeks to quash proceedings as against him.

(2.) The petitioner is a person engaged in social work towards upliftment of the downtrodden and equal placement of schedule caste and schedule tribes before the other communities. The complaint has been lodged by the Village Administrative Officer informing causing of disturbances and forceful downing of shutters of shops at about 2 p.m. on 20.05.2007 at Pennalurpettai. Such incident is said to have occurred owing to some dispute in the course of feeding conducted at Anjaneyar temple near Pennalurpettai. It is alleged that the petitioner has abused the shopkeepers and forced them to pull down the shutters.

(3.) The learned counsel for the petitioner would submit that no overtact was attributed to the petitioner, who is an advocate by profession. Further, the Village Administrative Officer had acted on the complaint of the traders association, Pennalurpettai which has been forwarded to him. It is submitted that the Village Administrative Officer has not enclosed the complaint of the traders association received by him, along with his complaint. It is in such circumstance, the learned counsel submits that it is fit case for quash of proceedings as against the petitioner.
