JUDGEMENT

(1.) Draft amendment is produced today during the course of hearing which has been permitted, to be carried out forthwith.

(2.) The plaintiff is the proprietary concern and is into the business of providing Shipping Service which may include necessary clearance certificates from the competent authorities, getting insurance, facilitating the services to the crew members of Ship, etc.

(3.) Defendant No.1 is the owner of the Ship M.V.SEA SHELL bearing Samoa Flag having IMO No.9296016 which has a registration of port APIA SAMOA. It has the permission for international voyage with all necessary compliance certificates including Provisional Certificate of Registration issued under the provisions of Samoa Shipping Act, 1998.
