This petition is filed under Article 226 of the Constitution of India challenging order dated 20.06.2019 passed by the Joint Secretary, Home Department (Appeals) in Arms Appeal No.40-C of 2017, whereby order dated 02.06.2017 passed by the District Magistrate, Junagadh came to be confirmed. The subject matter pertains to renewal of the application for possessing firearm, which which came to be rejected by the impugned orders.
(2.) Learned Advocate for the petitioner submitted that the petitioner is an agriculturist and possesses agriculture land in Junagadh District. The petitioner is also engaged in construction businesses Junagadh and Amreli Districts. It is submitted that the petitioner is possessing firearm licence for NP Bore Revolver /Pistol since 2010. It is submitted that late brother of the petitioner was also possession firearm licence and after his death, the weapon possessed by the brother of the petitioner was allowed to be purchased by the petitioner vide order dated 29.10.2010 passed by the District Magistrate, Junagadh. It is submitted that the licence of the petitioner was renewed from time to time. It is submitted that lastly, the petitioner made renewal application in the year 2016, which was rejected by the impugned orders.

Learned AGP opposes the grant of petition contending that when the authorities have found that there is no danger to the life of the petitioner, the petitioner wants to possess firearm licence just for a pleasure and for showmanship and that there are negative opinions from the Police Inspector and the District Superintendent of Police, this petition should not be entertained.
