JUDGEMENT

(1.) RULE. Ms. Krina Calla, learned AGP waives the service of notice of rule and Mr. S. A. Desai, learned advocate waives the service of notice of rule on behalf of the respondent No. 2. Present application has been preferred by the applicant original petitioner heir and legal representative of the original petitioner Mr. P. N. Pathak. Considering the averments in the application, the application is allowed. The applicant is permitted to be joined as petitioner No. 1/1 in the main Special Civil Application as heir and legal representative of the original petitioner Mr. P. N. Pathak. Registry is directed to amend the cause title accordingly. Rule is made absolute accordingly.
