JUDGEMENT

(1.) RULE. Shri Shivang Shukla, learned AGP waives service of rule on behalf of the opponents.

(2.) WITH the consent of the learned advocates appearing on behalf of the respective parties, the present application is taken up for final hearing today.

(3.) THE present application has been preferred by the applicant-original petitioner to restore the main Special Civil Application, which came to be dismissed for non-prosecution vide order dated 08/09/2009.
