(1.) By this writ-application under Article 226 of the Constitution of India, the writ-applicants have prayed for the following reliefs:-
(2.) It is the case of the writ-applicants that they hail from a poor strata of the society. They got their children admitted in the school by name Sarvopari Vidyalaya situated at Morbi. The admission was given by the school to the children of the writ-applicants having regard to the provisions of the Right of Children to Free and Compulsory Education Act, 2009. The school made it very clear at the time of admission that they would not be charging any tuition fees, but the parents would have to pay Rs.11,000/- per year for the bus services.
(3.) It appears from the materials on record that the writ-applicants are residing in proper Morbi, whereas, the school is situated at a distance of about 11 kms. from the town of Morbi. The children were left with no other option but to avail the services of school bus. Later, on account of monetary constraints, the writ-applicants were not able to avail the bus services. The writ-applicants have also complained about the in different attitude of the school authorities towards them and their children. In such circumstances, the writ-applicants have come before this Court with this writ-application.
