(1.) The petitioners challenge the action on the part of Respondent No.2 of not considering their educational qualification of Bachelor of Business Administration ('BBA' in brief) for the post of Head Teacher.
(2.) The brief facts of the case are that the petitioners belong to Socially and Educationally Backward Class (for short, 'SEBC'). Petitioner No.1 possess the educational qualification of BBA, B.Ed., M.Ed. And M.Com, whereas, petitioner No.2 possession educational qualification if BBA and B.Ed. Both the petitioners have cleared TET examination, and therefore, in response to the public advertisement dated 22.01.2017, they needed to appear for the post of Vidhya Sahayak (Gujarati Medium), Vidhya Sahayak (Other Medium) and Principals (Direct Recruitment) in upper primary section, i.e. Standard- 6 to 8.
(3.) According to the petitioners, they have cleared the Teachers Eligibility Test ( for short, 'TET') and they also possess non-creamy layer certificate issued by the competent authority. It is the grievance of the petitioners that the last date of submitting the online application forms is 03.02.2017, but, their online forms are not being accepted. They have, therefore, approached this Court, seeking following reliefs:
