(1.) WITH the consent of the learned Counsel appearing for both the sides, the matter is finally heard.
(2.) IT may be recorded that the petitioner had initially deposited the amount of Rs.5,00,000/ - with the Bank of India and it was to be renewed on maturity. However, there were disputes between the bank and the petitioner Trust. Ultimately, the petitioner Trust approached before the Banking Ombudsman and the Banking Ombudsman had passed the order in the proceedings of Complaint No.142/1999 -2000 and the operative portion of the order reads as under:

THE grievance of the present petitioner in main Special Civil Application was that in spite of the direction given by the banking Ombudsman, there was no compliance by the Bank and under these circumstances, the petitioner had approached this Court by preferring Special Civil Application complaining that as the order of the Banking Ombudsman had not complied with the banking licence of the Bank should be cancelled and the inaction on the part of respondent Nos.1 and 2 be declared as illegal.
