(1.) Shri D.G. Chauhan, learned counsel for the petitioner; Shri K.D. Pandya, learned counsel under the authority of Shri Mukesh H. Rathod informs that somewhere in the year 2006, the respondent Ishwarbhai D. Macwan has withdrawn the papers from his office and has left no instructions. In view of the said statement made by Shri Pandya, I proceed exparte.

The petitioner company, being aggrieved by the order dated 31st March, 1995, passed by the Industrial Tribunal, Ahmedabad in Complaint [I.T.] No. 203//91 in Reference [I.T.] No. 401/84 is before this Court with a submission that the Industrial Tribunal was absolutely unjustified in directing the petitioner company to pay a sum of Rs. 1,50,000/- to the respondent workman.
(3.) The respondent workman was Secretary of the Union, charges against him were that he instigated the workers; misbehaved with the officers of the company and created a situation where work of the company came to a standstill.
