By way of this petition the petitioner has challenged the impugned decision of the respondentBank dated 28.09.2001 whereby his case for compassionate appointment has been rejected on the ground that he had attained majority on 06.06.2001 i.e. about 10 years of death of the employee/father of petitioner.
(2.) The Facts Of The Case Are That Father Of The petitioner was serving as clerk with the respondentBank and he died in an accident, along with his mother, on 01.07.1991. Petitioner was minor at that relevant time. Petitioner applied on 13.12.1993 for compassionate appointment. He has further stated that the respondentBank has received no objection from Ministry of Finance, New Delhi, for considering the appointment of the petitioner after attaining majority on compassionate appointment. He has further stated that the petitioner became major on 06.06.2001 and thereafter he applied afresh for compassionate appointment. He has stated that once the Ministry of Finance, New Delhi, has decided to give no objection for considering the appointment of the petitioner on compassionate appointment, the respondentBank was unjustified in denying him appointment on compassionate ground.
