JUDGEMENT

(1.) The present application is filed under Section 439 of the Code of Criminal Procedure by the applicant for regular bail in connection with First Information Report being C.R.No.I -48 of 2016 registered with Bhuj City 'B' Division Police Station, District: -Kutch for the offences punishable under Sections 295 and 114 of the IPC and Sections 5(1)(1 -A), 6(B), 8(2)(4) of the Animal Preservation (Amendment) Act, 2011 and Section 11(L) of the Prevention of Cruelty to Animals Act.

(2.) Heard learned counsel for the applicant and learned Additional Public Prosecutor for the respondent -State.

(3.) Learned advocate for the applicant submits that similarly situated co -accused has been enlarged on bail by this Court. It is further submitted that substantial part of investigation is over and the charge -sheet is filed, now there is no possibility of tampering the evidence. It is submitted that the applicant is aged about 19 years and he is not having any criminal antecedents. It is further submitted that the applicant is ready and willing to abide by all the conditions which may be imposed by this Court and, therefore, on the ground of parity, the applicant may be enlarged on regular bail.
