The defendants have filed the present Second Appeal being aggrieved by the judgment and decree dtd.24/12/1987 passed in Civil Appeal No.188 of 1984 by the 2nd Extra Assistant Judge, Kheda at Nadiad setting aside the judgment and decree passed by the learned Civil Judge (J.D.), Khambhat in Regular Civil Suit No.314 of 1978 on 27/9/1984 whereunder the learned Civil Judge has dismissed the suit filed by the present respondents plaintiffs.
