JUDGEMENT

(1.) These petitions arise out of the same tender process. Two tenderers, one namely, Lakshmi Trading Company who was held qualified but failed to receive contract on account of price bidding and other namely, Divya Marketing who was disqualified at the threshold have filed these petitions.

(2.) Facts in brief are as under :

(3.) The State authorities needed to make purchase of various food items for six schools and hostels in tribal areas. A tender for supplying as many as 53 items was therefore, published inviting eligible contractors to supply their rates. Detail programme for supplying of such items for the period of one year was laid down in such notice. It was provided that the technical bids would be opened on 11.5.2015 followed by opening of the commercial bid on the later part of the day.
