JUDGEMENT

(1.) We have heard learned advocate Mr. K.G. Sukhwani for the petitioner and learned AGP Mr. Utkarsh Sharma for the respondents.

(2.) The main challenge in this petition is that the respondents are trying to invoke the bank guarantee No. 3311/IPEBG 120007 dated 23.4.2012 for an amount of Rs. 40 lakh as well as bank guarantee No. 3311/IPEBG 120009 dated 6.7.2012 for an amount of Rs. 25 lakh.

(3.) Therefore, this petition was filed by the petitioner for quashing of the demand made by respondent No. 2 from respondent No. 3 by letter No. AB/78 dated 21.1.2015 and No. AB/79 dated 21.1.2015. A further prayer was made that respondent No. 3 be restrained from encashing the bank guarantee No. 3311/IPEBG 120007 dated 23.4.2012 for an amount of Rs. 40 lakh as well as bank guarantee No. 3311/IPEBG 120009 dated 6.7.2012 for an amount of Rs. 25 lakh.
