JUDGEMENT

(1.) Heard learned counsel for the appellant. Mr. Mathurbhai Becharbhai Pankhania, Executive Engineer, Rajkot, who had sworn earlier affidavit and the affidavit filed today, is also present in the Court.

(2.) The present is an application under Section-5 of the Limitation Act, seeking condonation of delay of almost about 279 days in filing the Letters Patent Appeal.

(3.) The Special Civil Application No. 10646 of 1994 came to be finally disposed of by the learned Single Judge on 11.10.2002, while the present appeal has been filed on 18th December, 2003.
