JUDGEMENT

(1.) THIS appeal is at the instance of a convict -accused for the offences punishable under Sections 302, 324 and 504 of the Indian Penal Code and further under Section 135 of the Bombay Police Act and is directed against an order of conviction and sentence dated 7th January 2009 passed by the learned Additional Sessions Judge, Fast Track Court, Anand, in Sessions Case No.50 of 2008.

BY the aforesaid order, the learned Additional Sessions Judge found the appellant guilty of the offence punishable under Section 302 of the Indian Penal Code and consequently sentenced him to suffer life imprisonment and fine of Rs.5,000/ -. In default of payment of fine, the appellant was directed to undergo further rigorous imprisonment for two years. In the same manner, the learned Additional Sessions Judge also found the appellant guilty of the offence punishable under Section 324 of the Indian Penal Code and consequently sentenced him to suffer rigorous imprisonment for one year and fine of Rs.5,000/ -. In default of payment of fine, the appellant was directed to undergo further simple imprisonment for six months. In the same manner, the learned Additional Sessions Judge also found the appellant guilty of the offence punishable under Section 504 of the Indian Penal Code and consequently sentenced him to suffer rigorous imprisonment for six months and fine of Rs.250/ -. In default of payment of fine, the appellant was directed to undergo further rigorous imprisonment for one month. The learned Additional Sessions Judge also found the appellant guilty of the offence punishable under Section 135 of the Bombay Police Act and consequently sentenced him to suffer rigorous imprisonment for 15 days and a fine of Rs.100/ -. In default of payment of fine, the appellant was directed to undergo rigorous imprisonment for five days.
