(1.) All these petitions raise a common question of law and fact and as the issue involved in all the petitions are identical, the same are heard together and are decided by this common judgment and order.

By way of this petition under Article 226 of the Constitution of India, the petitioners have challenged the orders dated 3.4.2013 passed by the District Magistrate under the provisions of the Poison Act, 1919 (hereinafter referred to as "the Act" for the sake of brevity) read with the Gujarat Poisons (Possession and Sales) Rules, 1963 (hereinafter referred to as "the Rules" for the sake of brevity). The petitioners have also challenged the demand letters dated 16.4.2013 issued by the respondent authorities pursuant to the order passed by the District Magistrate. The petitioners have also prayed for an appropriate writ, order or direction directing the authorities i.e. the District Magistrate to consider the application of the petitioners for grant of licence under the Rules.
(3.) At the outset, it may be noted that the facts narrated in these petitions are almost identical and therefore, the facts narrated in Special Civil Application No.9089 of 2013 are taken as basis of this judgment.
