JUDGEMENT

(1.) This petition is filed seeking following reliefs:

(2.) Heard learned advocate Ms. Bhumika Vadodariya for learned advocate Murali Devnani, for the petitioner.

(3.) She submitted that husband of the petitioner expired during service on 6/5/2013. The husband of the petitioner had completed more than 30 years of service, and therefore the petitioner is entitled for the benefits flowing from Government resolutions from time to time. Since, the petitioner expired during service, the legal heirs are entitled for benefits flowing from the Government Resolution dtd. 5/7/2011 as also modified Government Resolution dtd. 7/4/2016. Therefore, the petitioner made an application seeking compensation in lieu of compassionate appointment on 28/11/2022. Learned Advocate submitted that under Government Resolution dtd. 5/7/2011, the legal heirs of deceased (petitioner) are entitled for the compensation in lieu of compassionate appointment, therefore appropriate direction may be issued to grant the said benefit as per modified policy dtd. 7/4/2016.
