JUDGEMENT

(1.) The present petition is filed challenging the inaction on the part of respondents to pay the pension of the petitioner, who retired as Class-IV employee with the respondent - State.

(2.) It is the grievance of the petitioner that he has been paid the benefit of 4th Pay Commission and though he is entitled for benefits of 5th, 6th and 7th Pay Commission Recommendations and consequential revision of pension, he has been denied the said benefit. In support of the prayers made, the petitioner has relied upon the decision of the Hon'ble Supreme Court in the case of State of Punjab vs. Jagitsingh reported in AIR (SC) 2016 0 5176.

(3.) Learned advocate Mr.Vishal Thakker appearing for the petitioner submitted that in the group of petitions being Special Civil Application No.403 of 2021 and allied matters, this Court vide order dtd. 12/12/2022 passed following order:
