KHUSIRAM BADRINARAYAN MEENA Vs. STATE OF GUJARAT

JUDGEMENT

(1.) This successive bail application is filed in connection with the FIR being C.R.No.11213015220110 of 2022 registered with Gondal City Police Station, Rajkot Rural, for the offences punishable under Sec. 8 (c), 20(b)(ii)(c) and 29 of Narcotics Drugs and Phototropic Substance Act, 1985.

(2.) Facts and circumstances giving rise to file present application are that, pursuant to the secret information, the raid was conducted at the factory namely Bansidhar Cement Product. During search of the office premises, the applicant accused Khushiram was found present and on extensive search of office of factory, narcotics substance - ganja weighing 24.800 Kgs was found nearby office table and accordingly, it has been seized by the police officials. The applicant apprehended on the spot. During course of investigation, it revealed that the co-accused Arjun Mahendrabhai, Mustufa Liyakat Saiyed, Narendra Dutt Harilal Jatt are also involved in transporting and selling of seized narcotics substance and accordingly, they were also arrested. After completion of investigation, chargesheet came to be filed against the applicant and others for the offence as referred above.

(3.) Bail application after filing of the chargesheet has been rejected by the Sessions Court concerned. Dissatisfied with the order, the instant application is preferred by the applicant.
