MEHULKUMAR BHIKHABHAI KHANDAVI Vs. STATE OF GUJARAT

JUDGEMENT

(1.) This petition is filed challenging non-inclusion of name of the petitioners in the merit list prepared pursuant to the advertisement No.LRB/202122/2 for the post of Armed/ Un Armed Police Constable - Lokrakshak and S.R.P.F. as Class-III in Gujarat Police Force. It is also prayed that action of the respondents in non-granting additional 5 Marks for the Certificates, which the petitioners have produced, are illegal.

(2.) Heard learned advocate Mr.Nabil Bloch for the petitioners. He submitted that pursuant to the advertisement issued by respondent No.2, the petitioners applied for the post of Armed/UnArmed Constable - Lokrakshak and S.R.P.F., Class-III in Gujarat Police Force. Having accepted their applications, the petitioners appeared in the physical test and written examination. After having physical test and written examination, the petitioners were called for documents verification. Since the name of the petitioners have not been figured after documents verification, this petition is filed.

On the other hand, learned Assistant Government Pleader Ms.Pooja Ashar for the respondents submitted that as referred in the advertisement, after having participated in the physical test and written examination, the petitioners were called for documents verification. Certificates at Annexure-B of all the petitioners have been considered and for verification, the same have been sent to Secretary, Gujarat State Athletics Association. In reference thereto, a communication has been received dtd. 17/5/2023 from the Secretary, Gujarat State Athletics Association that the Certificates produced by the petitioners of Indian Pacific Sports Federation, 2 nd Federation Cup National Games, 2021, where all the petitioners have participated in 4 x 100-meter relay, are not found genuine because Indian Pacific Sports Federation is not affiliated to parent Body of Athletics in India i.e. Athletics Federation of India, New Delhi. Since the Certificates have not been found genuine, the petitioners are not entitled for grace marks as referred in the advertisement.
