JUDGEMENT

(1.) The petitioner herein applied for renewal of passport bearing No.Z6710378 by an application dtd. 30/5/2023. The said application is numbered as ARN:23-0006986394. The respondent herein by a communication dtd. 3/7/2023 raised objections on the ground that the criminal case is pending against the petitioner herein. In view of the said communication dtd. 3/7/2023, the petitioner herein has approached this Court seeking the following reliefs:

(2.) Heard Mr. Kaivan K. Patel, learned advocate appearing for the petitioner and Mr. Kshitij Amin, learned advocate appearing for the respondent.

(3.) Mr. Kaivan K. Patel, learned advocate appearing for the petitioner, at the outset, submitted that the petitioner herein had stated in the said application that CBI Special Case No.11 of 2017 against the present petitioner is pending before the Special Judge, CBI Court No.8, City Civil & Sessions Court, Ahmedabad arising out of the FIR registered by CBI Office, Mumbai being RC No.0682015E0011/CBI/EOW/MUMBAI under Sec. 120-B read with Ss. 420 , 467 , 468 and 471 of the Indian Penal Code and under Sec. 13(2) read with 13(1)(d) of Prevention of Corruption Act , 1988 however, the respondent authority declined to consider the application dtd. 30/5/2023 preferred by the petitioner herein and in view thereof, the petitioner is constrained to approach this Court.
