JUDGEMENT

(1.) The petitioner is a non-banking finance company and present petition is filed through its authorized officer, seeking to invoke extraordinary jurisdiction of this Court under Article 226 and supervisory jurisdiction under Article 227 of the Constitution of India so also inherent powers of this Court under Sec. 482 of the Code of Criminal Procedure, 1973 with a prayer to release Muddamal Vehicle i.e Atul Shakti Three wheeler cargo rickshaw bearing RTO registration No.GJ 07 TV 2308.

(2.) Heard learned Advocates for the respective parties. Ruld. Ld. APP waives Rule for the State.

(3.) Learned counsel for the petitioner has relied upon orders passed by this Court in Special Criminal Application Nos. 2538 of 2014; 2283 of 2016 and 2300 of 2016.
