JUDGEMENT

(1.) Heard Mr. Bhavesh Patel, the learned advocate appearing for the petitioner and Mr. Ayaan Patel, the learned AGP for respondent No.1. Though served, none has appeared for respondent No. 2.

(2.) By way of present petition, the petitioner herein has prayed for direction to the respondent No.2 to amend and/ or correct the birth date of the petitioner as 01/10/1953 instead of 11/10/1953 in the birth certificate, as per other documents duly produced at Annexure "B" (Colly).

Mr. Bhavesh Patel, the learned advocate submitted that the petitioner was born on 1/10/1953 at Bavsar, Taluka: Himmatnagar, District: Sabarkantha and the birth of the petitioner was registered at Serial No. 23/1953 in the Register maintained as per the provisions of The Registration of Birth and Death Act, 1969 (for short "the Act"). It was submitted that at the time of registration of birth of the present petitioner, erroneously the date of birth was wrongly entered in the birth register of the Respondent No.2 Gram Panchayat, showing the date of birth of the petitioner as 11/10/1953 instead of 01/10/1953. It was submitted that in all other authenticated documents of the petitioner like School Leaving Certificate and Aadhar Card, PAN card, Pass-port etc, the date of birth of the present petitioner is mentioned as 01/10/1953 and, therefore, it is required to be corrected in the birth certificate issued by the respondent No.2. The authenticated documents of the petitioner like School Leaving Certificate and Aadhar Card, PAN card, Pass-port etc., are duly produced at Annenxure "B" (Colly).
